Phone Communications

User understands and acknowledges that communications with Bastion Health using e-mail, text messaging, and/or cell phone are not guaranteed to be secure or confidential methods of communication. As such, User hereby expressly waives Bastion Health’s obligation to guarantee confidentiality with respect to correspondence using such means of communication. User understands and acknowledges that all such communications may become a part of his/her medical records. By providing User's e-mail and  phone number on the appropriate enrollment form, User authorizes Bastion Health to communicate with User by e-mail and text regarding User's "protected health information" (“PHI”) (as that term is defined in HIPAA). Furthermore, by inserting User's email address in the appropriate registration enrollment form, User understands and acknowledges that:

a. E-mail and texting are not a secure medium for sending or receiving PHI and there is always a possibility that a third- party may gain access;

b. Although Bastion Health will take reasonable precautions to keep e-mail and texting communications confidential and secure, Bastion Health cannot assure or guarantee the absolute confidentiality of e-mail and texting communications.

c. In the discretion of Bastion Health, e-mail and textingcommunications may be made a part of User's permanent medical record; and User understands and agrees that E-mail/texting is not an appropriate means of communication regarding emergency or other time-sensitive issues or for inquiries regarding sensitive information.

d. In the event of an emergency, or a situation in which User could reasonably expect to develop into an emergency, User must call 911 or the nearest Emergency room, and follow the directions of emergency personnel.

e. If User does not receive a response to an e-mail message or text within one (1) business day, User agrees to use another means of communication to contact Bastion Health. Bastion Health expressly disclaims any liability associated with any loss, cost, injury, or expense caused by, or resulting from, a delay in responding to User as a result of any action, inaction or activity outside the control of Bastion Health or technical issues within Bastion Health control, including but not limited to (i) technical failures attributable to any Internet service provider, (ii) power outages, failure of any electronic messaging software, or failure to properly address e-mail and text messages, (iii) failure of Bastion Health’s computers or computer network, or faulty telephone or cable data transmission, (iv) any interception of e-mail, text communications by a third-party; or (v) User’s failure to comply with the guidelines regarding use of email communications set forth in this Agreement.
